Exemption: Content Produced by Third Parties

ebonytube.tv is not a "producer" (primary or secondary) of any visual material depicting real or simulated sexual acts, explicit or otherwise, found on the website. With respect to such, the operators confine their actions to the transmission, storage, retrieval, hosting and/or formatting of the content supplied by third-party users. All content that is supplied by third-party users is published on areas of ebonytube.tv which are under the control of third-party users. This exempts the operators of the website from compliance with Section 2257 records keeping and labeling obligations as stated in 28 C.F.R. §75.1(c)(4). Any content that is held to be illegal, obscene, harmful, harassing, defamatory or in any respect antithetical to the terms of use and policies of the website, may be removed at the sole discretion of the operator or owner, in accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).
